Contrary to popular perception, people who have OCD are not specifically protected by the Americans with Disabilities Act (ADA) of 1990. In fact, nobody is! Decisions about whether an employer is guilty of discrimination are handled on a case-by-case basis. However, the Equal Employment Opportunity Commission (EEOC), the governmental body that oversees issues related to the ADA, has specific stated guidelines about what constitutes discrimination (and what constitutes a disability). The Act states that it is not lawful for an employer to discriminate (that is, to fire a qualified employee or refuse to hire a qualified one) solely because she has a disability.
