Do You Need a Lawyer?

Most of the time you can file the paperwork and handle evictions without hiring a lawyer. But each case is different and sometimes legal representation is a good idea. One of those situations is when the unit is in a rent-controlled area. Rent control districts have special rules for evictions and a lawyer can be a big help.

Other times to consider hiring a lawyer are:

  • If your tenant hires an attorney

  • If the tenant's lawyer files a written complaint or affidavit

  • If your tenant contests or appeals an eviction (filed for any reason other than unpaid rent)

  • If your tenant files for bankruptcy

  • If your tenant appears to have assets, thus giving you a good chance to recover money
